Auto Knife – Not locking up

Hey there, everyone!
I purchased a new auto folder knife a couple of nights ago and just had a chance to mess with it tonight. (I will leave the name of the manufacturer/model out of it, as I have an email in to them as well to see whats going on and i don’t want to tarnish their reputation for this blade)

The issue:
I am having some issues with it locking open consistently. If I hold the knife and actuate the push button when the back of the blade (the side with the jimping) is pointed to the ground it will not lock up solid about 95% of the time. Actuating from every other position it works fine and locks up as it should. The position it is NOT locking up in obviously has gravity working against it. But I don’t think this is normal.

Any idea what is going on here? Is this something that is common among autos? (I am more of a manual or assisted opening guy)

Any advice is appreciated. And hopefully I explained this well enough.
